December 9, 2022 Opinion or Order Filing 7 ORDER OF DISMISSAL: The Court dismisses this action for lack of subject matter jurisdiction, see Fed. R. Civ. P. 12(h)(3), and because it is pending in the wrong venue, see 28 U.S.C. 1406(a). The Court, however, grants Plaintiff 30 days' leave to file an amended complaint in which he alleges facts sufficient to show that the Court has diversity jurisdiction to consider this action and that this action is pending in the proper venue. If Plaintiff fails to file an amended complaint within the time allowed, and cannot show good cause as to why such failure should be excused, the Court will enter judgment dismissing this action for the reasons set forth in this order. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore IFP status is denied for the purpose of an appeal. See Coppedge v. October 24, 2022 Opinion or Order Filing 4 TRANSFER ORDER: Plaintiff Eric Tymell Miles-Baker, a resident of New York County, proceeding pro se, filed these two actions against Banque de France and NatWest Group PLC. However, Plaintiff resides in New York county, which is located in the Southern District of New York, and thus it is conceivable that Plaintiff's claims, to the extent he has any, arose in New York county. Indeed, it appears that Plaintiff is seeking to avoid the imposition of a filing injunction in the Southern District of New York by filing these actions here. Accordingly, the Clerk of Court is directed to transfer these actions to the United States District Court for the Southern District of New York. The Court offers no opinion on the merits of these actions. The provision of Local Rule 83.1 requiring a seven-day stay is hereby waived. No summonses will issue from this Court, and the Clerk of Court is respectfully directed to mark these cases closed upon transfer.
