STIPULATION TO EXTEND TIME TO RESPOND TO COMPLAINT: IT IS HEREBY STIPULATED AND AGREED, by and between the undersigned, that: 1. The time for Defendant Kings International Group Inc. to answer, move, or otherwise respond to the Complaint in the above-captioned action is hereby extended to and including Monday January 16, 2023, to allow Plaintiff to decide whether it needs to amend the Complaint to add the required parties under Fed. R. Civ. P. 19 and to simplify/amplify its multiple causes of action, so that parties shall be saved from unnecessary preparation and filing of Court papers including but not limited to Answer (currently due December 20, 2022) which would be superseded by later amendments. 2. The parties are fully aware of the one (1) year statute of limitation after delivery of the goods or the date when the goods should have delivered under COGSA. Ocean liner's records show Plaintiff picked up the delivery from the ocean liner's container yard on February 2, 2022. 3. Should Plaintiff decide to amend its Complaint, Defendant be granted additional 21 days to respond to the amended Complaint from Plaintiff's filing of amended Complaint. So Ordered.
