January 4, 2023 Opinion or Order Filing 9 ORDER OF DISMISSAL: By order dated December 2, 2022, the Court held that it lacked subject matter jurisdiction of Plaintiff's complaint but granted Plaintiff to file an amended complaint within 30 days. That order specified that failure to comply would result in dismissal of the complaint. Plaintiff has not filed an amended complaint. Accordingly, the complaint, filed in forma pauperis (IFP) under 28 U.S.C. 1915(a)(1), is dismissed for lack of subject matter jurisdiction. See Fed. R. Civ. P. 12(h)(3). The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore IFP status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that an appellant demonstrates good faith when he seeks review of a nonfrivolous issue). December 2, 2022 Opinion or Order Filing 8 ORDER OF DISMISSAL: Plaintiff's complaint, filed in forma pauperis under 28 U.S.C. 1915(a)(1), is dismissed for lack of subject matter jurisdiction. See Fed. R. Civ. P. 12(h)(3). The Court directs the Clerk of Court to hold this matter open on the docket and grants Plaintiff 30 days' leave to amend his complaint to replead his allegations of subject matter jurisdiction. An amended complaint form is attached to this order. If Plaintiff fails to file an amended complaint within the time allowed, the Court will enter judgment dismissing this action for lack of subject matter jurisdiction. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal.
