ORDER TO SHOW CAUSE. It is hereby: ORDERED that Respondent Integr8 Fuels Inc. ("Integr8"), or its attorneys, show cause before the United States District Court, Southern District of New York, located at 500 Pearl Street, New York, NY 10007, on 12/15/2022 at 03:00 PM o'clock or as soon thereafter as counsel may be heard, why an order should not be issued against Respondent Integr8 directing that Integr8 be preliminarily enjoined from proceeding forward in arbitrating its claims against Amelia set forth in Integr8's Demand for Arbitration dated November 25, 2022 pending determination of Amelia's Petition for Declaratory Judgment, which requests relief in the form of an Order declaring no valid agreement to arbitrate exists between Amelia and Integr8; and it is further ORDERED that the arbitration proceeding shall be and hereby is stayed pending a hearing and decision on Petitioner's application for a preliminary injunction staying said arbitration until a final decision on Petitioner's application for a Declaratory Judgment that it is not obligated to arbitrate with Respondent and permanently enjoining such arbitration; and it is further ORDERED that Blank Rome LLP shall serve a copy of this Order to Show Cause, together with a copy of the papers upon which it is based, by email and Federal Express with delivery confirmation by December 7, 2022, on Respondent Integr8's attorneys in the New York arbitration Lennon Murphy & Phillips LLC, 420 Lexington Ave., Suite 300, New York, NY 10170, Attn: Patrick F. Lennon, Esq., e-mail address: plennon@lmplaw.net, which service shall be deemed good and sufficient service on Integr8; and it is further ORDERED that answering papers, if any, to this motion shall be served on Blank Rome LLP, 1271 Avenue of the Americas, New York, NY 10020, via the Electronic Case Filing system on or before December 12, 2022 and it is further ORDERED hat reply papers, if any, to this motion shall be served on counsel appearing for Respondent Integr8 in this proceeding via the Electronic Case Filing system on or before December 14, 2022.
