February 1, 2023 Opinion or Order Filing 21 STIPULATION AND ORDER: IT IS HEREBY STIPULATED and agreed among the undersigned attorneys for the parties that: 1. This action shall be stayed in its entirety until April 17, 2023, to allow the parties a period of 90 days to consummate a resolution of this action (hereinafter, the "Stay"). 2. Plaintiff's reply papers and opposition to the cross-motion shall be due April 17, 2023; 3. Plaintiff's deadline to file an amended complaint, should he choose to do so, shall be extended until April 17, 2023; 4. Defendant's reply papers on its cross-motion, and any response to an amended complaint (if filed), shall be due on May 17, 2023; 5. If either party comes to believe that the discussions concerning resolution are unlikely to be successful, that party may give written notice by email to opposing counsel of record that the Stay will automatically terminate/lift following the expiration of seven (7) business days, after which the Stay will automatically lift/terminate on the eighth (8th business day immediately following such written notice. 6. If the Stay is lifted before April 17, 2023 pursuant to the paragraph 5 of this Stipulation, then: Plaintiff's reply papers and opposition to the cross-motion shall be due four weeks from the date the Stay is lifted; Plaintiffs deadline to file an amended complaint, should he choose to do so, shall be four weeks from the date the Stay is lifted; and Defendant's reply papers on its cross-motion and response to an amended complaint, if any, shall be due four weeks from the date Plaintiff files his opposition to Defendant's cross-motion. 7. During the Stay, neither party (nor their respective agents) will commence any new or separate action against the other party (or their respective agents or affiliates). Nothing set forth herein shall foreclose any party from seeking expedited relief upon a lift of the Stay. SO ORDERED. The Court is in receipt of Defendant's motion to dismiss filed at ECF No. 11, as well as the parties' joint letter proposing a remaining briefing schedule for the motion to dismiss and Plaintiffs motion for summary judgment in lieu of complaint at ECF No. 16. Since this case has been removed to federal court, the parties are encouraged to review the undersigned's individual rules, which require that a pre-motion conference is required before the filing of a motion to dismiss. (See Individual Practices of Andrew L. Carter, Jr. 2.) However, given the posture of the case, the Court will dispense with the pre-motion conference requirement for Defendant's motion to dismiss. Accordingly, the Court will adopt the parties' proposed briefing schedule: (1) Plaintiff's reply in further support of his motion for judgment on the pleadings and in opposition to Defendant's motion to dismiss shall be filed by January 12, 2023 and (2) Defendant's reply in further support of its motion to dismiss shall be filed by February 13, 2023.
