March 7, 2023 Opinion or Order Filing 17 ORDER: The petitioner and his next friend are advised that they may consult the Pro Se Clinic operated by the New York Legal Assistance Group ("NYLAG") for the limited purpose of inquiring about a possible referral to pro bono immigration counsel. The NYLAG Pro Se Clinic is a free legal clinic for certain litigants who do not have lawyers, and it is run by a private organization; it is not part of, or run by, the Court. It cannot accept filings on behalf of the Court, which must still be made by any pro se party through the Pro Se Intake Unit. NYLAG cannot provide legal representation or legal advice to the petitioner. The sole purpose of contacting NYLAG would be to request a referral to pro bono immigration counsel. While NYLAG may be able to provide such assistance, a referral to pro bono immigration counsel is not guaranteed. The petitioner or his next friend may contact NYLAG for a possible referral by filling out the paperwork attached to this Order and mailing it to the NYLAG Pro Se Clinic at 100 Pearl Street, 19th Floor, New York, New York, 10004. Once the papers have been received, the Clinic will coordinate contact with the litigant. It may take up to two weeks for the Clinic to contact the litigant. Alternatively, the petitioner or his next friend may contact NYLAG for a possible referral by leaving a voicemail at (212) 659-5190, or by completing the Clinic's intake form on a computer at: https://tinyurl.com/NYLAG-ProSe-OI. January 19, 2023 Opinion or Order Filing 3 ORDER TO AMEND: The Court grants leave to file an amended petition for a writ of habeas corpus under 28 U.S.C. 2241, as specified above. The amended petition must be submitted to this Court's Pro Se Intake Unit within 60 days of the date of this order, be captioned as an "Amended Petition," and bear the same docket number as this order (1:23-CV-0242 (JGK)). An amended petition form is attached to this order, which should be completed as specified above. If this order is not complied with within the time allowed, and good cause cannot be shown to excuse such failure, the Court will deny the petition. Because there has been no substantial showing of a denial of a constitutional right, a certificate of appealability will not issue. See 28 U.S.C. 2253. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal.
