USCA Case Number 23-0286. Appellants move for an injunction enjoining arbitration proceedings pending this appeal, and for expedited briefing. Upon due consideration, it is hereby ORDERED that the previously entered stay of arbitration is TERMINATED and the motion for an injunction is DENIED because Appellants have not made a showing that they are entitled to that relief. LaRouche v. Kezer, 20 F.3d 68, 72 (2d Cir. 1994). It is further ORDERED that the motion for expedited briefing is GRANTED. In addition to all other issues the parties wish to raise, they should address in their briefs whether this Court has subject matter jurisdiction over this appeal. See 9 U.S.C. 16(b)(4) ("an appeal may not be taken [as of right] from an interlocutory order... refusing to enjoin an arbitration that is subject to [the Federal Arbitration Act."); Accenture LLP v. Spreng, 647 F.3d 72, 74 (2d Cir. 2011) (holding that this Court "lack[s] jurisdiction" where, as here, a party "seeks review of a district court's order "refusing to enjoin an arbitration").
