April 17, 2023 Opinion or Order Filing 25 ORDER: As discussed during the telephone conference this afternoon, all of the related actions except Reif v. Republic of Austria, No. 22-cv-10625, are consolidated for purposes of pretrial. The time for the defendants in those actions (Reif v. Carnegie Institute, No. 23-cv-346; Reif v. Oberlin College, No.23-cv-2108; Reif v. The Santa Barbara Museum of Art, No. 23-cv- 3009; and Reif v. The Art Institute of Chicago, No. 23-cv-2443) to move or answer with respect to the operative complaints is extended to Thursday, June 8, 2023. The plaintiffs may file an amended complaint in the Santa Barbara action by Monday, April 24, 2023. The plaintiffs should update the Court at the end of each month on the efforts to serve the defendants in the Austria action. Discovery is stayed in the Carnegie, Oberlin, Santa Barbara, and Art Institute of Chicago actions pending a decision on any motions to dismiss in those actions. To the extent there are any other outstanding deadlines imposed by Judge Torres, those are no longer operable. April 12, 2023 Opinion or Order Filing 21 ORDER: Accordingly: 1. The Court has already ruled on Carnegie Institute and Oberlin College's request that a single motion to dismiss briefing schedule be set for the related cases. Carnegie Institute, 23 Civ. 346, ECF No. 29. If Oberlin College intends to file a motion to dismiss in Reif v. Oberlin College, it is directed to either do so in accordance with the Court's Individual Practices in Civil Cases or explain whether it intends to rely on the pre-motion letter filed in Reif v. Carnegie Institute so Plaintiffs are able to respond. The same applies to AIC. The Court shall not adjourn Carnegie Institute's April 27, 2023 deadline to file its motion to dismiss on this basis. Accordingly, Carnegie Institute and Oberlin College's request is DENIED without prejudice to renewal. 2. By April 17, 2023, Plaintiffs shall state their position on Defendants' proposal that the cases be consolidated for pretrial purposes, but not for trial purposes. On April 11, 2023, another related case, Reif v. The Santa Barbara Museum of Art, 23 Civ. 3009, ECF No. 1, was removed to this Court. By April 17, 2023, Plaintiffs shall inform the Court whether there are or will be any other actions that that the Court should be aware of as it considers consolidation of the above-captioned cases. 3. By April 17, 2023, Defendant The Santa Barbara Museum of Art shall submit any opposition to consolidation. P. 1, it is ORDERED pursuant to Rules 30(b)(3) and 30(b)(4) of the Federal Rules of Civil Procedure that all depositions in this action may be taken via telephone, videoconference, or other remote means. It is further ORDERED pursuant to Rule 30(b) (5) that a deposition will be deemed to have taken place "before an officer appointed or designated under Rule 28" if such officer attends the deposition using the same remote means used to connect all other participants, so long as all participants (including the officer) can clearly hear and be heard by all other participants. If all parties consent to proceed before the Magistrate Judge, counsel for Defendant shall, by May 22, 2023, e-mail a fully executed Notice, Consent, and Reference of a Civil Action to a Magistrate Judge form, available at https://nysd.uscourts.gov/node/754 and attached to this order, to Orders_and_Judgments@nysd.uscourts.gov. If the Court approves that form, all further proceedings will then be conducted before the assigned Magistrate Judge rather than before me. An information sheet on proceedings before magistrate judges is also attached to this order. Any appeal would be taken directly to the United States Court of Appeals for the Second Circuit, as it would be if the consent form were not signed and so ordered. If any party does not consent to conducting all further proceedings before the assigned Magistrate Judge, the parties must file a joint letter, by May 22, 2023, advising the Court that the parties do not consent, but without disclosing the identity of the party or parties who do not consent.
