Following a telephone conference with the parties today, and for the reasons stated on the record, it is hereby ORDERED, as follows: 1. Based upon representations by Plaintiff's counsel in the June 12, 2023 Joint Letter (6/12/23 Joint Ltr., ECF No. 25), as well as during today's conference, Plaintiff's requests for a preliminary injunction and temporary restraining order (see 6/1/23 Proposed Order to Show Cause with Emergency Relief, ECF No. 5; Pl.'s 6/1/23 Mem., ECF No. 7) shall be deemed withdrawn. 2. Pursuant to Fed. R. Civ. P. 26(d)(1), the parties may immediately conduct limited discovery in the form of Local Civil Rule 33.3 Interrogatories and Fed. R. Civ. P. 34 Requests for Production of Documents. 3. Commencing on Tuesday, August 8, 2023, the parties may conduct discovery using all other discovery devices, including depositions. 4. No later than Friday, October 20, 2023, all discovery shall be completed. Extensions may be granted for good cause shown. 5. Within seven calendar days following the close of discovery, the parties shall submit a joint letter setting forth a proposed schedule for summary judgment motions. If the parties cannot agree on a proposed schedule, they shall each separately set forth in the joint letter their respective proposed schedules.
