NOTICE OF VOLUNTARY DISMISSAL PURSUANT TO F.R.C.P. 41(a)(1)(A)(i): PLEASE TAKE NOTICE that the claims of Plaintiff, JOEL TURNER, on behalf of himself, FLSA Collective Plaintiffs, and the Class are hereby dismissed, without prejudice, in their entirety as against Defendants, TISHMAN SPEYER PROPERTIES, INC., d/b/a TISHMAN SPEYER and RCPI HOLDCO, L.L.C, pursuant to the Federal Rules of Civil Procedure 41(a)(1)(A)(i), without costs or attorneys' fees to any party. On the basis of this notice of dismissal and the declaration of Plaintiff's counsel confirming that no settlement exists in this case (see ECF No. 13-1), this action is hereby DISMISSED. See Samake v. Thunder Lube, Inc., 24 F.4th 804, 810-11 (2d Cir. 2022) ("[I]n the absence of a settlement, the notice of dismissal should be so-ordered.").
