PRETRIAL SCHEDULING ORDER: This case has been assigned to me for all purposes. The plaintiffs in this case seek attorney's fees under 20 U.S.C. 1415(i)(3) as a prevailing party in an administrative hearing held pursuant to the Individuals with Disabilities Education Improvement Act ("IDEIA"). Accordingly, the following schedule shall govern the further conduct of pretrial proceedings in this case: 1. The plaintiffs shall produce to the defendant any records or documents necessary to assess the amount of attorney's fees by August 4, 2023. 2. The defendant shall answer and provide the plaintiffs with any offer of judgment by October 6, 2023. 3. In the event the defendant makes no offer of judgment or the plaintiffs decline to accept an offer of judgment, any party may bring a motion for summary judgment according to the following schedule: Motion served by November 10, 2023, Opposition served by December 1, 2023, Reply served by December 15, 2023.
