The Clerk of Court shall electronically notify the Civil Division of the U.S. Attorney's Office for the Southern District of New York that this Order has been issued. Within sixty days of the date of this order, the U.S. Attorneys Office shall file an answer or other pleadings in response to the petition. TEXT ORDER granting Respondent's request to transfer the case because this Court does not have jurisdiction. See Oppn 3-4, ECF NO #2 . Although Petitioner currently resides in a Rhode Island Re-Entry Center, the Bureau of Prisons New York, New York Residential Re-Entry Management Office is his custodian. See ECF No 2-1. Accordingly, this Court does not have jurisdiction over this case; the Southern District of New York does, however. See 28 U.S.C. 2242; Vasquez v. Reno, 233 F.3d 688, 691 (1st Cir. 2000); see also Mendez v. Martin, No. CV 15-408ML, 2016 WL 2849598, at *3 (D.R.I. Apr. 19, 2016), report and recommendation adopted, No. CV 15-408 ML, 2016 WL 2732182 (D.R.I. May 10, 2016). The Clerk is directed to transfer this case to the Southern District of New York.
