STIPULATION TO ACCEPT SERVICE AND SET TIME TO ANSWER/RESPOND: IT IS HEREBY STIPULATED by and between the undersigned counsel for Plaintiffs Paul Giordano ("Plaintiff") and Defendants HORTON POINT LLC and DIMITRI SOGOLOFF ("Defendants") that said Defendants shall have until October 20, 2023 to answer, move, or otherwise respond to the Complaint filed by Plaintiffs on or about August 7, 2023 (hereinafter "Complaint"). IT IS FURTHER STIPULATED AND AGREED that the above-referenced Defendants (all Defendant named in this action) hereby waive the affirmative defense of defective service of process with respect to Plaintiff's Complaint and agrees to accept service thereof, while reserving their right to raise any and all other defenses which may apply.
