October 6, 2023 Opinion or Order Filing 18 ORDER: This case was referred to Magistrate Judge Willis on October 5, 2023 for settlement. Dkt. No. 15. Should the parties wish to schedule a settlement conference, the Parties are directed to contact Courtroom Deputy Christopher Davis via email by October 13, 2023 at WillisNYSDChambers@nysd.uscourts.gov to provide three mutually agreeable dates in November, December, or January. Any conference will be held in-person at Courtroom 228, 40 Foley Square, New York, New York. Should the Parties not wish to schedule a settlement conference at this time, they should inform the Court via email by the same deadline. Parties must attend in-person with their counsel. Corporate parties must send the person with decision making authority to settle the matter to the conference. October 5, 2023 Opinion or Order Filing 17 CIVIL CASE MANAGEMENT PLAN AND SCHEDULING ORDER:This Civil Case Management Plan is submitted by the parties in accordance with Fed. R. Civ. P. 26(f)(3). All parties do not consent to conducting all further proceedings before a United States Magistrate Judge, including motions and trial. See28 U.S.C. 636(c). October 5, 2023 Opinion or Order Filing 16 ORDER It is hereby ORDERED that the October 11, 2023, initial pretrial conference is canceled. If the parties believe that a conference would nevertheless be useful, they should inform the court immediately so the conference can be reinstated. The case management plan and scheduling order will issue in a separate order. The parties' attention is particularly directed to the provisions for periodic status letters, and the need for a pre-motion letter to avoid cancellation of the final conference and setting of a trial date. It is further ORDERED that if Defendant seeks to file a motion to dismiss, it shall file a pre-motion letter pursuant to Individual Rules III.A.1 and III.C.2.
