STIPULATION TO DISMISS UNNECESSARY PARTIES: Plaintiffs Kimberly Ghahramani and Gregory Ghahramani ( collectively, "Plaintiffs"), and defendant, The Prudential Insurance Company of America ("Prudential") (collectively with Plaintiffs "the Parties"), through their respective counsel, and pursuant to Fed. R. Civ. P. 41(a)(1)(A)(ii), hereby stipulate to the following: Hereby stipulate to the following: 1. The Parties acknowledge that defendants Akin Gump Strauss Hauer and Feld LLP Accident Insurance Plan (the "Plan") and Akin Gump Strauss Hauer and Feld LLP as Plan Sponsor and Plan Administrator ("Akin Gump") are not necessary parties to this action because the accidental death and dismemberment benefits ("AD&D") at issue are fully insured by Prudential. 2. Prudential performed certain administrative functions with respect to Plaintiffs' claim for AD&D benefits brought pursuant to the terms of the Plan, including administering and determining Plaintiffs' claim pursuant to the terms of the Plan. As further set forth in this order. The Parties agree that all claims against defendants Akin Gump and the Plan may be dismissed without prejudice and without an award of fees or costs to any party. Wherefore, the Parties stipulate that Akin Gump and the Plan should be dismissed from this lawsuit without prejudice and without an award of fees or costs to any party and request that Akin Gump and the Plan be removed from the caption of this matter.
