November 28, 2023 Opinion or Order Filing 4 ORDER TO SHOW CAUSE: On November 22, 2023, this action was removed from New York Supreme Court. See ECF No. 1. Under Title 28, United States Code, Section 1404(a), a district court has discretion to transfer venue to any other district where a case might have been brought "for the convenience of parties and witnesses, in the interest of justice." 28 U.S.C. 1404(a); see, e.g., New York Marine and General Ins. Co. v. Lafarge North America, Inc., 599 F.3d 102, 112 (2d Cir. 2010) (discussing the factors to be considered in determining whether to transfer venue). In light of In re Cottonwood Vending, LLC, Case No. 23-43027, a related bankruptcy proceeding pending in the United States Bankruptcy Court for the Eastern District of New York, the Court is inclined to exercise its discretion under Section 1404(a) by transferring this case to the Eastern District of New York. Any party objecting to such transfer shall file a letter detailing the basis for that objection by December 6, 2023.
