Filing 8 MOTION FOR LEAVE TO SUBMIT DIGITAL RECORDINGS. Document filed by Jouan J. Jackson.(sc) |
Filing 7 ORDER OF DISMISSAL: The Court dismisses this action. The Court dismisses Plaintiff's federal-law claims for failure to state a claim on which relief may be granted. See 28 U.S.C. 1915(e)(2)(B)(ii). The Court declines to consider, under its supplemental jurisdiction, Plaintiff's state-law claims. See 28 U.S.C. 1367(c)(3). The Court, however, grants Plaintiff's motion for leave to file a second amended complaint insofar as the Court grants Plaintiff 60 days' leave to file a second amended complaint, as specified above.7 (ECF 6.) If Plaintiff fails to file a second amended complaint within the time allowed, and cannot show good cause to excuse such failure, the Court will direct the Clerk of Court to enter a judgment dismissing this action for the reasons set forth in this order. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore IFP status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Court directs the Clerk of Court not to close this action, as the Court has granted Plaintiff leave to replead his claims in a second amended complaint. SO ORDERED.
