JOINT STIPULATION AND CONSENT PRELIMINARY INJUNCTION: NOW THEREFORE IT IS STIPULATED AND AGREED TO by Plaintiffs, Coach IP Holdings, LLC, Coach Services, Inc. and Tapestry, Inc., and Defendants, ACS Group Acquisitions LLC and Vinci Brands LLC, that: (i) Defendants, ACS Group Acquisitions LLC and Vinci Brands LLC, are enjoined under Federal Rule of Civil Procedure 65, until further Order from this Court, from selling, distributing, or dealing in or with any and all COACH Goods, other than sales to complete written customer orders received by Defendant Vinci Brands LLC as of June 30, 2023, whether or not such orders are cancelable; and (ii) In view of the foregoing, no additional preliminary injunction briefing or preliminary injunction hearing is necessary (see ECF 45). So Ordered. The parties are directed to meet and confer to discuss next steps in this case, including the possibility of settlement given the consent preliminary injunction. JOINT STIPULATION ADJOURNING HEARING AND EXTENDING TEMPORARY RESTRAINING ORDER: NOW THEREFORE IT IS STIPULATED AND AGREED TO by Plaintiffs, Coach IP Holdings, LLC, Coach Services, Inc. and Tapestry, Inc., and Defendant, ACS Group Acquisitions LLC, that: (i) No hearing before a Part I judge is necessary on Plaintiffs' request for a preliminary injunction; (ii) The preliminary injunction hearing set by the Order, originally scheduled for December 27, 2023 at 10:00 a.m., is adjourned; (iii) The matters in dispute should be ruled on by the Honorable Lorna G. Schofield, as related issues are already before the Court in related Case No. 1:23-cv-05409-LGS; and (iv) The Order's temporary restraining order is extended by agreement under Federal Rule of Civil Procedure 65, pending further ruling(s) from the Honorable Lorna G. Schofield. So Ordered. The parties are directed to meet and confer to discuss whether they will stipulate to a consent preliminary injunction, similar to the one filed in Case No. 23 Civ. 5409, to obviate the possible need for a preliminary injunction hearing on the pending motion against ACS and any contemplated motion against Vinci.
