February 27, 2024 Opinion or Order Filing 11 CIVIL JUDGMENT: For the reasons stated in the January 24, 2024, order, this action is dismissed. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from the Courts judgment would not be taken in good faith. SO ORDERED. (Signed by Judge Laura Taylor Swain on 2/27/2024) (Attachments: #1 Pro Se Appeals Package) (sha)
February 13, 2024 Opinion or Order Filing 10 ORDER: By order dated January 24, 2024, the Court granted Plaintiff's motion for permission for electronic case filing. The Court granted the motion based on Plaintiff's affirming that she completed the Court's CM/ECF introduction course on January 4, 2024, and that she understood her obligation to comply with the requirement that she file her documents electronically and not submit any documents to the Pro Se Intake Unit for scanning and docketing. (See ECF 1 2, 5.) Since the Court granted this motion, Plaintiff has submitted several documents for filing to the undersigned's chambers' email. As Plaintiff is required to submit her documents electronically, these documents will not be filed on ECF or addressed by the Court. Should Plaintiff seek assistance in filing her documents electronically, she must contact the ECF Help Desk at (212) 805-0800. If Plaintiff continues to submit documents to the undersigned's chambers' email, the Court will vacate its order granting Plaintiff permission to file documents electronically. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). (Signed by Judge Laura Taylor Swain on 2/12/2024) (nb)
January 24, 2024 Opinion or Order Filing 9 ORDER OF DISMISSAL WITH LEAVE TO REPLEAD granting #7 Motion for Permission for Electronic Case Filing. Plaintiff's complaint, filed in forma pauperis under 28 U.S.C. 1915(a)(1), is dismissed. Any claims brought on behalf of her company, Infinite Light LLC, are dismissed without prejudice to Plaintiff's obtaining counsel to assert her claims on her behalf. The claims brought against the Hong Kong Defendants are dismissed for improper venue, with 30 days' leave to file an amended complaint that demonstrates this federal district is a proper venue for Plaintiff's claims. The claims brought against Stephen Mathias are dismissed because, as a U.N. employee, he is immune from this suit. Plaintiff's motion for an order of protection (ECF 4) and motion requesting the appointment of pro bono counsel (ECF 6) are denied. The Clerk of Court is directed to terminate these two motions. Plaintiff's motion for permission to participate in electronic case filing in this action (ECF 7) is granted. The Court directs the Clerk of Court to hold this matter open on the docket until a civil judgment is entered. SO ORDERED.
