STIPULATION REGARDING MEDIATION: NOW THEREFORE IT IS STIPULATED AND AGREED AS FOLLOWS: 1. Copley Defendants' time to answer or otherwise respond to the Complaint is hereby adjourned to May 31, 2024. 2. To the extent the parties desire a referral to the Southern District's mediation program, the parties shall file a joint request by March 25, 2024. 3. If the mediation is not successful and the parties have not reached a settlement of this action, the parties shall notify the Court by May 15, 2024 whether Plaintiffs consent to arbitration. If Plaintiffs do not consent, Copley Defendants shall file a motion to compel arbitration and stay this action by May 31, 2024; 4. Plaintiffs and Copley Defendants agree that by entering into this Stipulation and mediating this case, that Copely Defendants are not waiving their right to arbitrate Plaintiffs' claims. The entering into this Stipulation and engaging in mediation is not inconsistent with Copley Defendants' intent to exercise their right to arbitrate. 5. Nothing in this Stipulation shall constitute an admission or denial by any party. SO ORDERED.
