March 19, 2024 Opinion or Order Filing 16 ORDER: Given that Plaintiff is pro se, the Court will reschedule the initial pretrial conference in this case for April 9, 2024, at 12:00 p.m. in Courtroom 23B of the Daniel Patrick Moynihan United States Courthouse, 500 Pearl Street, New York, New York, 10007. However, by failing to appear at a Court-ordered conference to which Plaintiff was aware, Plaintiff has wasted the time and expense of Defendant and flouted this Court's order. Plaintiff must inform the Court by April 2, 2024, if he intends to continue prosecuting this case and confirm that he will attend the conference on April 9. If Plaintiff does not confirm his continued prosecution of this matter by April 9, then the Court will adjourn the April 9 conference, and it may also dismiss Plaintiff's action without prejudice for failure to prosecute. See Link v. Wabash R.R. Co., 370 U.S. 626, 630-31 (1962); Feurtado v. City of New York, 225 F.R.D. 474, 477 (S.D.N.Y. 2004); see also Kotler v. Jubert, 986 F.3d 147, 156 (2d Cir. 2021). The Clerk is directed to mail a copy of this Order to Plaintiff and Defendant is directed to email and mail this Order to Plaintiff immediately. Defendant shall file proof of service of this Order. February 20, 2024 Opinion or Order Filing 8 ORDER granting #7 Letter Motion to Reopen Case; granting #7 Letter Motion to Continue. The Court is satisfied that removal was timely based on Defendant's uncontested representation that Plaintiff never properly served Defendant. See Murphy Bros. v. Michetti Pipe Stringing, Inc., 526 U.S. 344, 347-48 (1999) (a named defendant's time to remove is not triggered "by mere receipt of the complaint unattended by any formal service"). The Court is also satisfied that it has subject-matter jurisdiction because "the Montreal Convention completely preempts state law and, therefore, confers federal-question jurisdiction." Canela v. JetBlue Airways Corp., No. 22-cv-00004 (FB), 2023 WL 1801996, at *1 n.1 (E.D.N.Y. Feb. 7, 2023); accord Singh v. N. Am. Airlines, 426 F. Supp. 2d 38, 45 (E.D.N.Y. 2006); In re Air Crash at Belle Harbor, Nos. 02-cv-04765, 02-cv-01448 (RWS), 2002 WL 31356266, at *3-5 (S.D.N.Y. Oct. 17, 2002); see also Cohen v. Am. Airlines, Inc., 13 F.4th 240, 243 (2d Cir. 2021) (per curiam) (noting, without concern, that the defendant had "removed the case to district court, contending that because the alleged incident took place aboard an airplane, the [Montreal Convention] applied, and thus the district court had federal question jurisdiction").
