ORDER with respect to #43 Motion to Amend/Correct #33 Order Appointing Receiver. On February 12, 2024, the Court granted plaintiff U.S. Bank Trust Company's ("U.S. Bank") application to appoint a receiver for the real property located at One Jericho Plaza and Two Jericho Plaza, Jericho, New York 11753 (the "Property"). Dkt. 33. Defendants did not object to the appointment of a receiver. Dkt. 27. On March 26, 2024, U.S. Bank filed a motion to amend the receivership order to permit the receiver to engage a broker to market the Property for sale and to authorize the receiver to sell the Property at a public or private sale subject to the approval of this Court. Dkt. 43. U.S. Bank also filed a memorandum of law and declaration in support. Dkts. 44-45. The Court directs defendants to respond to the motion by April 1, 2024. Lagowitz (the "Receiver") of Trigild NL Group, LLC, maintaining an office at 24 Church Street, Montclair, New Jersey 07042, be and hereby is appointed as the receiver of Borrower's Assets (as defined herein).
