STIPULATION TO ARBITRATION AND STAY OF PROCEEDINGS: By agreement of the Parties, Plaintiffs will submit their claims in this action to arbitration before the American Arbitration Association ("AAA") pursuant to the arbitration clause within the Card Agreement for Best Buy credit cards issued by Citibank, N.A., dated 2022. 2. Plaintiffs shall promptly initiate the arbitration after the Court so-orders this stipulation or takes substantially similar action adopting the Parties' agreement to arbitrate. 3. This action, including discovery between the Parties, shall be stayed pending the outcome of the arbitration pursuant to 9 U.S.C. 3. 4. Citibank hereby appears in this action and waives service of the Summons and Complaint, such that Citibank's deadline to answer or otherwise respond to the Complaint shall be April 9, 2024, but the Parties agree that Citibank need not file a responsive pleading in this action in light of the stay pending arbitration. 5. Judgment upon any award rendered in the arbitration may be entered in this Court. SO ORDERED. It is further ORDERED that all other dates and deadlines, including the Initial Pretrial Conference, are adjourned sine die. The parties shall file a joint letter updating the Court on the status of the arbitration within 90 days of the date of this Order. The Clerk of Court is respectfully directed to terminate Dkt.
