February 28, 2024 Opinion or Order Filing 2 ORDER OF DISMISSAL UNDER 28 U.S.C. 1651: By order dated and entered January 25, 2024, the Court barred Plaintiff from filing any future civil action in this court in forma pauperis ("IFP") without leave of the court to file. See Moshir v. I.G.P.P. U.S.A. Inc., ECF 1:23-CV-9902, 6 (S.D.N.Y. Jan. 25, 2024). Plaintiff has filed this new pro se action and has not paid the fees to bring this action. Thus, the Court understands that Plaintiff seeks to proceed IFP. He has not, however, sought leave of the court to file. The Court therefore dismisses this action without prejudice for Plaintiff's failure to comply with the Court's January 25, 2024 order in Moshir, ECF 1:23-CV-9902, 6.The Court certifies, pursuant to 28 U.S.C. 1915(a)(3), that any appeal from this order would not be taken in good faith and therefore IFP status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Court directs the Clerk of Court to enter a judgment dismissing this action for the reasons set forth in this order.The Court also directs the Clerk of Court to provide Plaintiff a copy of this order and the accompanying judgment should he appear at the court's Pro Se Intake Unit window.
