April 8, 2024 Opinion or Order Filing 23 ORDER SCHEDULING DEFAULT JUDGMENT BRIEFING AND SHOW CAUSE HEARING: It is hereby ORDERED that Defendants shall file any opposition to the motion for default judgment by April 22, 2024. Defendant Second Wind is cautioned that corporate entities may appear in federal court only through licensed counsel, see Lattanzio v. COMTA, 481 F.3d 137, 140 (2d Cir. 2007), and where such an entity "repeatedly fails to appear by counsel, a default judgment may be entered against it," Grace v. Bank Leumi Tr. Co. of N.Y., 443 F.3d 180, 192 (2d Cir. 2006) (internal quotation marks omitted). It is further ORDERED that Defendants shall appear and show cause before this Court on Thursday, May 23 at 9:30a.m., why an order should not be issued granting a default judgment against it. The conference will be held in person in Courtroom 906 of the Thurgood Marshall Courthouse, 40 Foley Square, New York, New York 10007. With respect to Defendant B.C.D.E., who has now appeared, and in the event that Defendant Second Wind appears or opposes the motion for default judgment prior to the date of the show cause hearing, the parties shall prepare to treat that conference as the Initial Pretrial Conference. Any appearing parties--including Defendant B.C.D.E. and Plaintiff--shall follow the pre-conference procedures specified in Rule II(A)(5) of the Court's Individual Rules & Practices, including by submitting a joint letter addressing certain topics and a proposed case management plan no later than the week prior to the conference. It is further ORDERED that Plaintiffs serve Defendant Second Wind with (1) a copy of the motion for default judgment and all supporting papers; and (2) a copy of this Order by close of business April 10, 2024. Within two business days of service, Plaintiffs must file proof of such service on the docket. SO ORDERED. March 21, 2024 Opinion or Order Filing 11 ORDER: Plaintiff commenced this action by the filing of a Complaint on February 19, 2024. Dkt. No. 1. Defendants were served with the Summons and Complaint on February 27, 2024, and the deadline to answer or otherwise respond to the Complaint was March 19, 2024. Dkt. Nos. 8, 9. That deadline has now passed, and Defendants appear to be in default. Accordingly, Plaintiff shall file any motion for default judgment, in accordance with the Court's Individual Rules and Practices (available at https://nysd.uscourts.gov/hon-margaret-m-garnett), within two weeks of the date of this Order. If Plaintiff's counsel submits calculations in support of any motion for default judgment, Plaintiffs counsel shall also email native versions of the files with the calculations (i.e., versions of the files in their original format, such as in ".xlsx") to Chambers at GartnettNYSDChambers@nysd.uscourts.gov. If or when a motion for default judgment is filed, the Court will enter a further Order setting a deadline for any opposition and reply and scheduling a show cause hearing. If no motion for default judgment is filed by the deadline set forth above, the case may be dismissed for failure to prosecute without further notice to the parties. Plaintiff shall serve a copy of this Order electronically and/or by first-class mail on Defendants within two business days from the date of this Order and shall file proof of such service within three business days of the date of this Order.
