Filing 5 CIVIL JUDGMENT: For the reasons stated in the April 18, 2024, order, this action is dismissed. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from the Court's judgment would not be taken in good faith. (Signed by Judge Laura Taylor Swain on 4/18/2024) (Attachments: #1 Appeal Package) (nb) |
Filing 4 ORDER OF DISMISSAL: By order dated March 4, 2024, the Court directed Plaintiff, within thirty days, to (1) resubmit the signature page of the complaint with an original signature; and (2) submit a completed and signed amended request to proceed in forma pauperis (IFP) or pay the $405.00 in fees required to file a civil action in this court. That order specified that failure to comply would result in dismissal of the complaint. Plaintiff has not complied with the Court's March 4, 2024 order. Accordingly, the complaint is dismissed without prejudice. See 28 U.S.C. 1914, 1915. The Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore IFP status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that an appellant demonstrates good faith when he seeks review of a nonfrivolous issue). The Court directs the Clerk of Court to enter judgment. (Signed by Judge Laura Taylor Swain on 4/18/2024) (nb) |

The Court certifies, pursuant to 28 U.S.C. 1915(a)(3), that any appeal from this Order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). Signature Page due by 4/3/2024. Fees due by 4/3/2024. Amended IFP application due by 4/3/2024.
