May 15, 2024 Opinion or Order Filing 7 ORDER OF SERVICE: The Court dismisses Plaintiff's claims against the Dutchess County Jail for failure to state a claim on which relief may be granted. See 28 U.S.C. 1915(e)(2)(B)(ii). The Court also dismisses Plaintiff's claims against the City of Poughkeepsie Police because city agencies or departments do not have the capacity to be sued under New York law. The Court directs the Clerk of Court to add to the caption of the complaint John Doe Police Officers 1-3. The Clerk of Court is directed to mail a copy of this order and the complaint to City of Poughkeepsie Corporation Counsel at: 62 Civic Center, 3rd Floor, Poughkeepsie, NY 12601. The Clerk of Court is instructed to issue a summons for the City of Poughkeepsie, complete the USM-285 form with the address for this Defendant, and deliver all documents necessary to effect service to the U.S. Marshals Service. Finally, the Clerk of Court is instructed to mail an information package to Plaintiff. SO ORDERED. (Signed by Judge Philip M. May 9, 2024 Opinion or Order Filing 4 STANDING ORDER IN RE CASES FILED BY PRO SE PLAINTIFFS (See 24-MISC-127 Standing Order filed March 18, 2024). To ensure that all cases heard in the Southern District of New York are handled promptly and efficiently, all parties must keep the court apprised of any new contact information. It is a party's obligation to provide an address for service; service of court orders cannot be accomplished if a party does not update the court when a change of address occurs.
