Filing 254 OPINION AND ORDER re: (234 in 2:08-cv-08781-HB-RLE) MOTION to Certify Class and Appoint Class Representatives filed by New Jersey Carpenters Health Fund, Local 74 USWU Welfare Fund, New Jersey Carpenters Vacation Fund. I have considered the pa rties' remaining arguments and find them to be without merit. Because the proposed Offerings in both Harborview and RALI comport with the class certification requirements under Rule 23(a) and (b), as I articulated these requirements in my prior decisions, the class in each case is expanded to include those offerings. In Harborview, Iowa Public Employees Retirement Systems and the Midwest Operating Engineers Pension Trust Fund are added as Class Representatives. Plaintiffs' motions for class modification and designation of new class representatives are GRANTED, except to the extent that Local 74 USWU Welfare Fund is not designated as a class representative in the RALI case.
