Filing 60 OPINION AND ORDER granting in part and denying in part 43 Motion for Summary Judgment. For the reasons set forth above, Defendants' Motion for Summary Judgment isGRANTED as to Plaintiffs Fomteenth Amendment and conspiracy claims, and DENIED as to Plaintiffs state and federal malicious prosecution claims and Banamen's derivative claim based on Plaintiffs malicious prosecution claims. The Clerk of the Court is respectfully directed to terminate this motion. Doc. 43.Additionally, Plaint iff is directed to show cause in writing by October 5, 2012, why his claims against Bookless should not be dismissed without prejudice for failure to prosecute. Plaintiffs submission to this Court should include accurate and up-to-date information about Bookless' bankruptcy proceeding.The parties are directed to appear for a conference on October 30, 2012 at 11:30 am.
