OPINION AND ORDER: I find that genuine disputes of material fact exist as to: (a) the nature of the use permitted by Plaintiff based on the understandings between the parties and (b) the existence and extent of infringement. Additionally, I find tha t none of the fair use factors point in favor of a finding of fair use. Accordingly, Plaintiff's Motion for Partial Summary Judgment is DENIED and Defendants' Cross-Motion for Summary Judgment is DENIED. The Clerk of Court is directed to t erminate the pending Motions, (Docs. 35, 37). The parties are directed to appear before me on October 24, 2013 at 11:00 a.m. for a status conference. SO ORDERED.
