OPINION AND ORDER: Defendants' motion to dismiss Plaintiffs third and fourth causes of action is GRANTED. As Plaintiff has voluntarily dismissed his first cause of action, the only claim that remains in this case is Plaintiffs second cause of ac tion. No claims remain as to Defendants Town of Poughkeepsie or Town of Poughkeepsie Police Department, and they are hereby dismissed from this action. The remaining Defendants are directed to file an answer by September 14, 2012. The patties are directed to appear before the Court for an initial conference on Wednesday, October 17, 2012 at 11:00am.
