Filing 119 OPINION AND ORDER: In light of the foregoing analysis, the Court grants the County Defendants' Motion To Dismiss without prejudice. The Court grants Correct Care's Motion To Dismiss as to Plaintiff's failure to protect claim, witho ut prejudice, and denies the Motion with respect to the deliberate indifference and state tort law claims. As noted, even though Plaintiff has filed several amended complaints in this Action, because this is the first adjudication on Defendants 39; Motion to Dismiss, the claims that are dismissed are dismissed without prejudice and Plaintiff may file a Seventh Amended Complaint within thirty days of this Opinion and Order.
