OPINION & ORDER re: 65 MOTION to Dismiss filed by Morton, County of Westchester, Westchester County, Hubert, Rome. For the foregoing reasons, the Court denies Defendants' Motion To Dismiss with respect to Plaintiff 9;s excessive force claim against Morton and grants it with prejudice in all other respects In light of the fact that Plaintiff has failed to respond to Defendants' Motion and has not communicated with the Court in any way since the pre-motio n conference held on June 15, 2015, Plaintiff is ordered to notify the Court of his intention to pursue this Action within 14 days or risk dismissal of his case for failure to prosecute.
