OPINION AND ORDER: Defendants' Motion to Dismiss is hereby GRANTED as to Plaintiff's Counts I and II, and DENIED as to Count III. Plaintiff's Motion for Summary Judgment is hereby DENIED as moot as to Counts I and II, and GRANTED as to Count III. Defendants are hereby ORDERED to grant Plaintiff's 20 applications for special permits for the construction of nodes on existing utility poles in the Town of Greenburgh, (Heimdahl Decl. Ex. 26), and issue the special permits. The Clerk of Court is directed to terminate the pending Motions (Docs. 27, 32), and close the case. SO ORDERED.
