OPINION AND ORDER re: 90 MOTION for Summary Judgment . filed by St. Anthony's School, Roman Catholic Archdiocese of New York, St. Anthony's Shrine Church, 103 MOTION for Summary Judgment (Plaintiff's Motion ). filed by St. Anthony's School, Roman Catholic Archdiocese of New York, St. Anthony's Shrine Church. Defendants' Motion for summary judgment is GRANTED and Plaintiff's Cross-Motion to strike Defendants' ministeri al-immunity defense is DENIED. The federal claims are dismissed with prejudice and the state claims are dismissed without prejudice. The Clerk of Court is respectfully directed to terminate the pending Motions, (Docs. 90, 103), enter judgment for Defendants, and close the case. SO ORDERED.
