Kase & Druker, Esqs. is entitled to fees and costs in the amount of $42,125.45 for its work on this case. Mi guel B. and Kelvonte C. are entitled to compensatory damages in the amount of $100 each, and NYYC is entitled to nominal damages in the amount of $1. For the foregoing reasons, Defendants Cross-Motion for Summary Judgment is GRANTED IN PART, in that the claims against the individual Defendants, other than Belmont, and the Office of the Town Clerk are dismissed, and otherwise DENIED, and Plaintiffs Mot ion for Summary Judgment is GRANTED as to the remaining Defendants in that the statute at issue is unconstitutional, and DENIED as to the dismissed Defendants. The Clerk of Court is respectfully directed to terminate the pending motions. (Docs. 26, 30.) The parties are directed to confer and submit, no later than December 22, 2015, a proposed Order enjoining the enforcement of § 183-4(B) of the Town of Harrison Code. The parties are further directed to appear before this Court on January 21, 2016 at 2:00 p.m. to discuss the determination of the damages and attorneys fees to which Plaintiffs may be entitled.
