OPINION & ORDER: For the foregoing reasons, Defendant's Motion To Dismiss is granted in part and denied in part. Defendant is directed to file an Answer to the SAC within 20 days from the date of this Opinion. The Clerk of Court is respectfully directed to close case numbers 13-CV-906, 13-CV-1144, 13-CV-4099, 13-CV-4101, 13-CV-4150, 13-CV-4235, 13-CV-4236, 13-CV-4237, 13-CV-4242, 13-CV-4243, 13-CV-4316, 13-CV-4318, 13-CV-4611, 13-CV-4612, 13-CV-5556, and 15-CV-6107, terminate the pending Motion (Dkt. OPINION AND ORDER: Defendant's Motion To Dismiss is granted in part and denied in part. To the extent that Plaintiffs make claims based on the mere use of EPA fuel economy estimates in advertisements or on Monroney Stickers, those claims are d ismissed because they are preempted by federal law and, in any event, fail to state a claim. Additionally, Plaintiffs' MMW A claim and unjust enrichment claim under California and New York law are dismissed. The Clerk is respectfully requested to terminate the Motion. (Dkt. No. 63.)
