OPINION & ORDER re: 192 SECOND MOTION to Vacate 119 Default Judgment, . filed by Marianina Oil Corp. For the foregoing reasons, Defendant Marianina's motion to set aside the default judgment against it is GRANTED. Defend ant has until May 16, 2017 to file responsive pleadings. Failure to comply with the Court's orders may result in sanctions, including the reentry of default against Marianina. The parties are directed to inform Magistrate Judge McCarthy of thi s decision and to modify their case management plan accordingly. The Clerk of the Court is respectfully directed to set aside the entry of default against Marianina and vacate the December 1, 2015 judgment at ECF No. 119. OPINION AND ORDER re: 34 MOTION to Dismiss Plaintiff's Second Amended Complaint filed by Singer Real Estate Group, LLC, 36 MOTION to Dismiss filed by Kenneth C. Seus, Getty Properties Corporation, Tyree Environmental Corporation, Michael C. Kenny. For the reasons stated above, both motions to dismiss the CERCLA claim are GRANTED. The Getty Defendants' motion to dismiss the RCRA claim is DENIED. Singer's motion to dismiss the state law claims is GRANTE D as to trespass and common law strict liability, but is DENIED as to Navigation Law§ 181(1), private nuisance, and negligence. The Clerk of Court is respectfully requested to terminate the motions at docket numbers 34 and 36. Defendants shall serve and file their answers to the complaint by January 21, 2015. SO ORDERED.
