OPINION & ORDER re: 95 MOTION to Dismiss , filed by Philip D. Heath, M. Barnes, Brian Fischer, D. Keysor. Defendants' Motion is granted in part and denied in part. Defendants' Motion is granted with respect to Plaintiff� 39;s claim against Barnes. Because Plaintiff has already had an opportunity to amend, that dismissal is with prejudice. Defendants' Motion is denied with respect to Fischer, Heath, and Keyser. The Court will hold an initial conference on Apri l 4, 2017 at 10:00 AM. OPINION & ORDER re: 59 MOTION to Dismiss . filed by C. Dowtin, R. Brereton, Shrader, J. Freeman, M. Barnes, Albert Prack, L. Gould, T. Bellinger, R. Woody, Jr., C. Gamble, S. Luciano, K. White, Philip D. Heath, Brian Fisc her, D. Keysor. The Court grants Defendants' Motion in part, and the claims against Fischer, Heath, and Barnes are hereby dismissed. Additionally, Plaintiff's claims against Keyser are dismissed, except for the claim relating to his r eview of Plaintiff's disciplinary proceedings. These dismissals are without prejudice, meaning that Plaintiff will be given an opportunity to amend his complaint, but he must do so within 30 days. Defendants' Motion is in all other respects denied. The Clerk of the Court is respectfully requested to terminate the pending Motion. (See Dkt. No. 59.) SO ORDERED. (Signed by Judge Kenneth M.
