Filing 40 OPINION AND ORDER re: 29 MOTION to Dismiss for Lack of Subject Matter Jurisdiction and/or Granting Summary Judgment filed by Pasquale Cartalemi, Jr., AAA Carting and Rubbish Removal, Inc. For the above reasons, Defendants' M otion for Judgment on the Pleadings is granted in part and denied in part. In particular, Defendants' Motion based on Plaintiff's FLSA minimum wage violation claim is granted, but their Motion based on lack of subject matter jurisdiction is denied. Defendants' Motion for Summary Judgment is denied without prejudice to renewal at the close of discovery. The Clerk of the Court is respectfully directed to terminate the pending Motion. (See Dkt.
