OPINION AND ORDER re: 13 MOTION to Dismiss . filed by June Yozzo, Correct Care Solutions New York, Michael Kelly, Correct Care Solutions LLC, Tufaro, Ulloa, Westchester County, Linda Beyer. In light of the foregoing analy sis, the Court denies Defendants' Motion To Dismiss Plaintiff's Complaint. However, because Plaintiff did not respond to Defendants' Motion to Dismiss, Plaintiff is to advise the Court in writing, within 45 days of this Opinion and Order, of his intention to pursue this case. Failure to do so may result in dismissal of this case. The Clerk of Court is respectfully requested to terminate the pending Motion. (Dkt. No. 13.) (Signed by Judge Kenneth M.
