OPINION & ORDER re: 36 FIRST MOTION to Dismiss filed by Ms. Kiernan, W. Lee, Valado, C. Jackson, D. Malark. For the foregoing reasons, the Defendants' motion to dismiss is GRANTED in part and DENIED in part. Defendants' motion is denied with respect to Plaintiff's retaliation claim-that Defendants denied him protective custody in retaliation for his filing of federal lawsuits. Plaintiff's remaining claims, however, are dismissed. Defendant shall have unt il 60 days from the date of this Order to file responsive pleadings on the remaining claim. An initial in-person case management and scheduling conference pursuant to Fed. R. Civ. P. 16 is scheduled for May 20, 2016, at 10:30 a.m., at the United Stat es Courthouse, 300 Quarropas Street, Courtroom 218, White Plains, New York 10601. Plaintiff shall appear via telephone. The parties shall also complete a Civil Case Discovery Plan and Scheduling Order and bring it to the conference. The Court respect fully directs the Clerk to terminate the motion at ECF No. 36.
