For the foregoing reasons, Defendants' motions to dismiss are GRANTED in part and DENIED in part. The Court dismisses the Manner of Arbitration DFR Claim, as against the Union; the Arbitration Delay DFR Claim, as against the Union; the CPLR and NYCRR sanction cl aims, as against LSHV; the fraud claim, as against LSHV; and the breach of the implied covenant of good faith claim, as against all Defendants. The remaining claims are as follows: the Termination DFR Claim, as against the Union; breach of the CBA, a s against LSHV; and fraud, as against the Union. Defendants are directed to file answers within 30 days hereof. The parties are directed to appear for an initial pre-trial conference on May 13, 2016 at 10:15 a.m. Parties shall bring a completed case management plan to the initial pre-trial conference. The Court respectfully directs the Clerk to terminate the motions at ECF Nos. 15 and 24. SO ORDERED. (Initial Conference set for 5/13/2016 at 10:15 AM before Judge Nelson Stephen Roman.)
