MEMORANDUM AND OPINION re: 28 SECOND MOTION to Dismiss , filed by Bret Wida, Brega D.O.T. Maintenance Corporation, Vinnie Marzella, Richard Brega. The Court grants Defendants' Motion and dismisses Plaintiff's Amended Comp laint. As discussed, the Court will give Plaintiff 45 days to submit a Second Amended Complaint which will replace the Amended Complaint in its entirety.
