October 7, 2019 Opinion or Order Filing 38 ORDER for 32 Motion for Attorney Fees filed by Luis Guzman, 37 Report and Recommendation. Accordingly, the Court adopts the R&R as the opinion of the Court, and plaintiff's motion for approval of the contingent fee agreement is GRANTED . Plaintiff's counsel is entitled to recover $16,712.25 in attorney's fees under 42 U.S.C. § 406(b). However, upon plaintiff's counsel's receipt of funds awarded under 42 U.S.C. § 406(b), plaintiff's counsel promptly shall refund directly to plaintiff the $6,130.00 he received under the EAJA. July 11, 2018 Opinion or Order Filing 25 MEMORANDUM OPINION AND ORDER. The R&R is adopted as the opinion of the Court. Defendant's motion for judgment on the pleadings is DENIED. (Doc. #14). Plaintiff's motion for judgment on the pleadings is GRANTED IN PART and DENIED IN PART WIT HOUT PREJUDICE. (Doc. #19). The case is REMANDED to the Social Security Administration for further administrative proceedings consistent with the R&R, pursuant to 42 U.S.C. § 405(g), sentence four. The Clerk is instructed to enter Judgment accor dingly and close this case.
