Filing 68 OPINION & ORDER re: 41 MOTION for Summary Judgment filed by Correct Care Solutions, Hamad Skinner, 48 FIRST MOTION to Dismiss the Complaint filed by Roberts, County of Westchester. For the reasons stated above, CCS D efendants' Motion for Summary Judgment and County Defendants' Motion To Dismiss are granted. In light of Plaintiff's pro se status, and because this is the first adjudication of Plaintiff's claims on the merits, Plaintiff's claims against the County Defendants, and County Defendants only, are dismissed without prejudice. If Plaintiff wishes to file an Amended Complaint alleging additional facts and otherwise addressing the deficiencies identified above with respect to County Defendants, Plaintiff must do so within 30 days of the date of this Opinion & Order. The failure to do so may result in the dismissal of the claims against County Defendants with prejudice. Within seven days of the date of this Opinion & Ord er, County Defendants shall provide the Court with a service address for Defendant Roberts or confirm that the current address is still the proper address at which to effect service. Should Plaintiff choose to file an Amended Complaint, the Court w ill issue an Order of Service. The Clerk of Court is respectfully directed to terminate the pending Motions, (see Dkt. Nos. 41, 48), enter judgment in favor of Defendants CCS and Dr. Skinner, and mail a copy of this Opinion & Order to Plaintiff at the address listed on the docket. SO ORDERED.
