Filing 82 OPINION AND ORDER: re: 56 MOTION for Summary Judgment, filed by Ellen L. Baker, Esq., John Does 1 through 5, David L. Posner, Esq., Rebecca Blahut, Esq., McCabe & Mack LLP, Donna Morrissey, 80 SECOND LETTER MOTION for Or al Argument With Respect to Defendants' Motion For Summary Judgment addressed to Judge Cathy Seibel from Jimmy M. Santos, Esq. dated December 22, 2017, filed by Carol A. Flynn. For the reasons stated above, Defendants' motion for summary judgment is GRANTED, (Doc. 56), and Plaintiff's request for oral argument is moot, (Doc. 80). Plaintiff's claims under the ADA are dismissed with prejudice, and her claims under the NYSHRL are dismissed without prejudice. The Clerk of Court is respectfully directed to terminate the pending motions, (Docs. 56, 80), enter judgment for Defendants, and close the case, and as further set forth in this order.
