OPINION AND ORDER re: 98 MOTION for Summary Judgment filed by N.P. Uszynski. For the foregoing reasons, Defendants motion for summary judgment is granted. The Court certifies under 28 U.S.C. § 1915(a)(3) that any appeal from t his order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. OPINION AND ORDER: The motions of defendants Ulloa, Smiley, and Volmer to dismiss are GRANTED in their entireties. The motion of defendant N.P. Usznyski to dismiss is GRANTED as to the state law claims, and DENIED as to the Section 1983 claim. T he Clerk is instructed to terminate the motions (Docs. ##27, 43) and to terminate defendants Ulloa, Smiley, and Volmer. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal.
