Filing 60 OPINION & ORDER re: 31 MOTION to Dismiss . filed by Basil Townsend, 40 MOTION to Dismiss . filed by Local 412 of the CSEA, Inc. Local 1000, AFSCME, AFL-CIO, 36 CROSS MOTION to Dismiss . filed by State of Ne w York (Hudson Valley DDSO), 57 MOTION to Amend/Correct 1 Complaint, Notice to Attorney to Re-File Document - Deficient Docket Entry Error, . filed by Vivienne A Brunson-Bedi. For the foregoing reasons, Plaintiffs motion for l eave to amend is DENIED and the Defendants' motions are GRANTED. Plaintiff has failed to properly and timely serve both HVDDSO and CSEA, warranting dismissal and this Court declines to grant an extension to cure the defective service. As to De fendant Townsend, Plaintiff cannot, as a matter of law, raise a cognizable claim against him under Title VII. This Court otherwise declines to exercise supplemental jurisdiction over the state law claims since it is dismissing the federal claims. The Clerk of the Court is respectfully directed to terminate the motions at ECF Nos. 31, 36, 40, and 57. The Clerk of the Court is also respectfully directed to te1minate the action. (Signed by Judge Nelson Stephen Roman on 5/1/2018) (kgo) |
