Filing 104 OPINION AND ORDER re: 88 MOTION for Summary Judgment . filed by Derek Mastromonaco, 89 FIRST MOTION for Summary Judgment . filed by George Winsman, Robert Pavone, Timothy Joyce, County Of Westchester. Plaintiff 9;s motion for partial summary judgment is DENIED. Defendants' cross-motion for summary judgment is DENIED as to plaintiff's excessive force claim against Officer Joyce, and GRANTED in all other respects. The Clerk is instructed to term inate the motions. (Docs. ##88, 89). All counsel are directed to appear at a status conference on October 5, 2018, at 9:15 a.m., at which time the Court will set a trial date and a schedule for pretrial submissions. By September 24, 2018, the parties shall submit a Joint Pretrial Order in accordance with the Court's Individual Practices. (Status Conference set for 10/5/2018 at 09:15 AM before Judge Vincent L.
